Mehr als zehn Jahre nach Bekanntwerden der Manipulationen an Diesel-Fahrzeugen von Volkswagen geht die strafrechtliche Aufarbeitung in eine weitere Runde. Vor dem Landgericht Braunschweig beginnt ein dritter großer Betrugsprozess im Zusammenhang mit der sogenannten Abschaltsoftware. Angeklagt sind fünf zum Teil ehemalige Mitarbeiter des Konzerns und eines Zulieferers. Die Staatsanwaltschaft wirft ihnen unter anderem Beihilfe zum gewerbsmäßigen Betrug vor; im Falle einer Verurteilung drohen mehrjährige Haftstrafen. Es gilt die Unschuldsvermutung.

Im Mittelpunkt steht erneut die Software, mit der Millionen Fahrzeuge der VW-Marken auf Prüfständen bessere Abgaswerte erreichten als im regulären Straßenbetrieb. Nach Auffassung der Ermittler entstand den Käufern dadurch ein Milliardenschaden. Die nun angeklagten Beschuldigten sollen zwischen November 2006 und September 2015 in unterschiedlichen Zeiträumen an Entwicklung und Implementierung der Funktion beteiligt gewesen sein oder sie unterstützt haben. Ziel sei es gewesen, Volkswagen hohe Gewinne zu sichern und darüber mittelbar von Gehalts- und Bonuszahlungen zu profitieren.

Der neue Prozess fügt sich ein in eine Serie von Verfahren, mit denen deutsche Gerichte den Dieselskandal juristisch aufarbeiten. Bereits im Mai 2025 endete nach mehreren Jahren Verhandlung der erste große Betrugsprozess in Braunschweig mit Urteilen gegen vier Angeklagte: Zwei erhielten Haftstrafen, zwei Bewährungsstrafen. Die Verurteilten sehen sich als Bauernopfer und haben Revision eingelegt; eine Entscheidung darüber steht aus, der tatsächliche Haftantritt dürfte sich entsprechend verzögern. Ein zweites Verfahren gegen fünf teils ehemalige Führungskräfte des Konzerns läuft seit November 2025, den vier Männern und einer Frau werden unter anderem Betrug, Steuerhinterziehung und strafbare Werbung vorgeworfen. Für diesen Prozess sind Termine bis mindestens Ende 2026 angesetzt.

Prominent, aber derzeit ruhend, bleibt das Verfahren gegen den früheren Vorstandschef Martin Winterkorn. Er war im ersten Braunschweiger Prozess zunächst Mitangeklagter, sein Verfahren wurde jedoch aus gesundheitlichen Gründen abgetrennt und wegen Verhandlungsunfähigkeit vorläufig eingestellt. Winterkorn hatte vor Gericht strafrechtliche Verantwortung zurückgewiesen. Ein rechtskräftiges Urteil im Kontext der Dieselaffäre liegt hingegen aus München vor: Ex-Audi-Chef Rupert Stadler wurde dort zu einer Bewährungsstrafe von einem Jahr und neun Monaten sowie zur Zahlung von 1,1 Millionen Euro verurteilt. Parallel dazu hatte VW in den USA, wo der Skandal 2015 durch eine Mitteilung der Umweltbehörde EPA öffentlich geworden war, bereits mehr als 20 Milliarden Dollar an Strafen und Entschädigungen gezahlt; frühere Mitarbeiter wurden dort zu langen Freiheitsstrafen verurteilt.
